FINAL USER'S AGREEMENT TO USE GEMINISOFT PIMMY

IMPORTANT - READ CAREFULLY

This final user's agreement ("Agreement") is an agreement between the final user (a person or a company) and Geminisoft about the software product listed above, which includes alla software for computer, any eventually included storage support (disks), written material and "online" electronic documentation ("SOFTWARE PRODUCT"). In addition, the SOFTWARE PRODUCT includes any updates and addition to the original SOFTWARE PRODUCT supplied by Geminisoft. By installing, copying, downloading, accessing or using in any way the SOFTWARE PRODUCT, the user accept all the terms of this agreement. If the user does not accept the terms and conditions of this agreement, he should give back to Geminisoft all material regarding this SOFTWARE PRODUCT.

LICENSE FOR THE SOFTWARE PRODUCT

This SOFTWARE PRODUCT is protected by copyrigth laws and international treaties about intellectual property.

This SOFTWARE PRODUCT is not sold, but its usage is permitted by a non-exclusive license. Geminisoft will continue to have the property of this copy of the SOFTWARE PRODUCT.

TRY & BUY

The SOFTWARE PRODUCT is sold using the "Try & Buy" schema. The user can install and test the SOFTWARE PRODUCT for the period of time indicated on the web site, documentation or displayed when the programa starts. During of after that period the user must buy a license from Geminisoft to continue using the SOFTWARE PRODUCT. If the user does not buy a license, after the expiration date the program stop working and/or may not be used any longer.

"BETA TEST" VERSIONS

Intermediate versions of the SOFTWARE PRODUCT, so-called "beta test" versions, can be used under the same terms of this license, but they can be used freely (at no cost) for a limited period of time. Expiration date of each beta test version is indicated on the web site, documentation or displayed when the program starts. After the expiration date the program stop working and/or may not be used any longer.

ADDITIONAL COSTS

If the SOFTWARE PRODUCT is downloaded from Internet, additional connection cost may be requested by the provider and are in charge of the user. If the SOFTWARE PRODUCT is found on a commercial CD-ROM, the cost of the CD-ROM itself is not related to this SOFTWARE PRODUCT, but only to the CD-ROM as requested by the distributor.

1. LICENSE TERMS

This agreement give the user the following right:

• Installation and use. This license is strictly personal, user can install and use one copy of this SOFTWARE PRODUCT on one computer only. Exception to this general principle, this SOFTWARE PRODUCT can be installed on one or more computers on the condition that they all are owned by the same owner of the SOFTWARE PRODUCT or assigned to him even for a limited period of time. In any case the SOFTWARE PRODUCT must be always used by the same user who owns the license. Technical rules described in minimum requirements and in the installation procedure may limit this right by using protection means which Geminisoft could apply to the SOFTWARE PRODUCTS.

2. OTHER RIGHTS AND LIMITATIONS

• Limitations on decoding, decompiling and disassemblying. User can not decode, decompile or disassembly this SOFTWARE PRODUCT, unless permitted by national law.
• Component division. This SOFTWARE PRODUCT can not be separated in parts to be used on different computers.
• Leasing. User can not lease this SOFTWARE PRODUCT.
• Trademarks. This agreement does not give to the user the right to use any mark or registered mark of Geminisoft.
• Technical support service. Geminisoft may provide a technical support related to this SOFTWARE PRODUCT. The service is managed by plans and programs described in the written or online documentation and/or by other material provided by Geminisoft. Any additional software supplied to the user during the technical support is considered as part of this SOFTWARE PRODUCT and subject to terms and conditions of this agreement.
• Transferring. The initial user may trasmit this SOFTWARE PRODUCT and this agreement to other people. The transmission must include the whole SOFTWARE PRODUCT and the receiving user must accept the terms and conditions of this agreement.
• Selling and distribution of the SOFTWARE PRODUCT. This SOFTWARE PRODUCT may not be sold and/or object of commercial activities. It can be freely distributed (e.g. on Internet or collections on CD-ROM), but the price requested for the SOFTWARE PRODUCT can not be greater than the mere cost of the media and/or distribution. In addition the SOFTWARE PRODUCT must be distributed in the orginal form, with all the contained files and without adding any other program, file or document. The property of the SOFTWARE PRODUCT must also be clear in the distribution package (Geminisoft - www.geminisoft.com).

3. COPYRIGHT

Any right and intellectual property related to this SOFTWARE PRODUCT (including but not only any image, picture, animation, video, audio, music and text), the written material and any copy of thi SOFTWARE PRODUCT, are of property of Geminisoft. In addition Geminisoft has any right not explicity mentioned on this agreement. The right and intellectyal property of any contents available via this SOFTWARE PRODUCT, are of property of the related owner and may be protected by laws and international treaties on copyright. This agreement does not grant the user any right to use this content.

4. WARRANTY

Geminisoft provides this SOFTWARE PRODUCT "as is", without any warranties of any kind. Geminisoft can not guarantee perfomances and result obtainable by this SOFTWARE PRODUCT. Geminisoft does not give any explicit and implicit warranties about the non violation of right ot other subjects. Geminisoft in no ways will be considered responsible for any damage (direct and indirect), any loss of profits and any complaints.

This agreement is regulated by Italian laws.
